Terms of Service

Last updated: July 17, 2026. These terms govern pankesh.in, Pankesh.Tech, Pankesh.School, and related services.

1. Provider, acceptance, and scope

Pankesh is the customer-facing brand for the websites, products, and digital services described here. The legal person or entity named on your accepted proposal, order, invoice, subscription record, or onboarding agreement is your contracting service provider. By using a Pankesh service, you agree to these Terms and the linked policies.

  • The applicable legal name, billing details, tax information, and service address are shown in the customer order or invoice where required.
  • General legal and service notices may be sent to contact@pankesh.in.
  • Pankesh includes pankesh.in, services.pankesh.in, school.pankesh.in, tenant school portals, dashboards, APIs, support channels, and paid or free digital services.
  • If you use the services for a company, school, coaching institute, agency, or other organization, you confirm that you are authorized to accept these Terms for that organization.
  • A signed proposal, invoice, statement of work, subscription order, or school onboarding agreement may add project-specific terms.
  • You must follow all laws that apply to your business, school, users, students, staff, and content.

2. Accounts and access

You are responsible for the accuracy of account information and for activity under your login, administrator account, school tenant, API key, or connected integration.

  • Keep passwords, OTPs, API keys, payment credentials, and admin access secure.
  • Tell us quickly if you suspect unauthorized access, data leakage, account takeover, or misuse.
  • We may suspend access if account details are false, payment is overdue, security is at risk, or the service is being misused.
  • For Pankesh.School, the school or institute is responsible for assigning correct staff roles and removing users who no longer need access.

3. Services, projects, and delivery

Pankesh provides technology services including websites, web apps, school ERP, dashboards, AI automation, cyber security, digital marketing, integrations, maintenance, and consulting.

  • Custom work is delivered according to the agreed scope, milestones, content, access, timelines, and approval process.
  • Your delay in providing content, approvals, hosting access, domain access, payment, brand assets, or third-party credentials may extend delivery timelines.
  • Change requests outside the agreed scope may require a new estimate, revised timeline, or separate invoice.
  • We may use reliable third-party tools, hosting providers, payment processors, communication gateways, analytics tools, and AI providers to deliver the service.

4. AI features and outputs

Some Pankesh services may include AI-assisted features, automation, chatbots, content generation, coding assistance, document processing, lead qualification, school workflows, or support tools.

  • You are responsible for the prompts, files, data, instructions, and permissions you submit to AI-enabled features.
  • Do not submit confidential, sensitive, student, health, financial, biometric, or regulated data into AI features unless your organization has approved it and the required safeguards are in place.
  • AI outputs can be incomplete, inaccurate, similar to outputs given to others, or unsuitable for legal, medical, financial, educational, employment, admission, safety, or high-impact decisions without human review.
  • You must review AI outputs before publishing, sending, relying on, or using them in decisions about any person.
  • Where third-party AI providers are used, their systems may process inputs and outputs as subprocessors or independent providers depending on the feature and agreement.

5. Customer content and data

You retain ownership of content, data, files, logos, text, media, student records, school records, customer records, and project materials that you provide to us.

  • You grant Pankesh the permission needed to host, process, copy, modify, transmit, display, back up, and use your content only to provide, secure, support, improve, and document the services.
  • You confirm that you have the rights, permissions, notices, and consents required to provide the content and data to Pankesh.
  • We may use aggregated or de-identified operational data to improve reliability, security, product planning, and analytics.
  • We do not sell your personal data.

6. Intellectual property

Pankesh owns its platforms, source code, templates, designs, workflows, documentation, brands, tools, know-how, and pre-existing materials. You own your customer content and final deliverables only as described in the applicable written order.

  • Unless a written agreement says otherwise, custom deliverables transfer to you after full payment, excluding Pankesh pre-existing code, reusable components, internal tools, libraries, and third-party materials.
  • Open-source and third-party components remain governed by their own licenses and provider terms.
  • You may not copy, resell, reverse engineer, bypass, scrape, overload, or misuse Pankesh platforms or internal tools.
  • Feedback, ideas, and suggestions you share may be used by Pankesh without restriction or compensation.

7. Payments, taxes, and subscriptions

Fees, taxes, setup charges, recurring subscriptions, usage charges, renewal terms, and payment schedules are shown in the proposal, invoice, checkout page, or order form.

  • Invoices must be paid by the due date. Late or failed payments may pause delivery, support, hosting, dashboard access, integrations, or subscription services.
  • You are responsible for applicable taxes, payment gateway charges, domain fees, hosting fees, app store fees, SMS or WhatsApp charges, and third-party provider costs unless your written order says otherwise.
  • Subscriptions renew according to the selected billing period until cancelled, downgraded, paused, or terminated.
  • Refunds and cancellations are handled under the Refund Policy.

8. Third-party services

Our services may connect with third-party providers such as domain registrars, hosting, email, SMS, WhatsApp, payment gateways, analytics, cloud storage, maps, CRMs, school integrations, and AI providers.

  • Third-party services are governed by their own terms, pricing, data practices, limits, and uptime commitments.
  • You authorize us to connect, configure, and transmit data to third-party services when needed for your requested workflow.
  • Pankesh is not responsible for outages, policy changes, pricing changes, account restrictions, or data practices of third-party providers.
  • You must ensure that your use of connected services is lawful and allowed by the third-party provider.

9. Prohibited use

You must not use Pankesh to break the law, harm others, abuse systems, compromise security, or violate anyone's rights.

  • Do not send spam, phishing, malware, illegal content, deceptive marketing, or harmful automation.
  • Do not upload or process data that you do not have permission to use.
  • Do not attempt unauthorized access, scraping, credential attacks, rate-limit bypass, reverse engineering, or platform disruption.

10. Suspension and termination

You may stop using our services at any time, subject to payment obligations, project commitments, data export rules, and cancellation terms in the applicable order.

  • We may suspend or terminate service for non-payment, security risk, legal requirement, abuse, repeated support misuse, or violation of these Terms.
  • Before termination, we may provide notice when practical, but urgent security, legal, or abuse situations may require immediate action.
  • After termination, we may delete or archive data according to the Privacy Policy, DPA, retention rules, and applicable law.
  • Sections on payments, intellectual property, confidentiality, liability, indemnity, data handling, and disputes survive termination.

11. Disclaimers and limitation of liability

Services are provided with reasonable skill and care, but we do not promise uninterrupted access, error-free operation, specific business results, rankings, leads, revenue, admissions, marks, security perfection, or AI accuracy.

  • To the maximum extent allowed by law, Pankesh is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
  • Our total liability for any claim is limited to the amount you paid to Pankesh for the affected service during the three months before the event giving rise to the claim.
  • Nothing in these Terms limits liability that cannot legally be limited.
  • You agree to indemnify Pankesh against claims caused by your content, users, instructions, unlawful use, data permissions, third-party accounts, or breach of these Terms.

12. Law, changes, and contact

These Terms are governed by the laws of India, unless mandatory consumer or data-protection law provides otherwise. Courts with jurisdiction over Pankesh's principal place of business will handle disputes where allowed by law.

  • We may update these Terms when services, law, security requirements, or business practices change.
  • Material changes will be posted on this page or communicated through reasonable channels.
  • Continuing to use the services after an update means you accept the updated Terms.
